These Terms and Conditions ("Terms") govern your access to and use of the website operated by Jetts Fitness Pty Ltd (ACN 123 921 3260), trading as Hungardia, along with any related services, memberships, or programs we offer. By accessing our website or signing up for a membership, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Acceptance of Terms

Your continued use of our website and services constitutes your acceptance of these Terms in their entirety. If you do not agree with any part of these Terms, you must discontinue use of the website and refrain from purchasing or maintaining a membership. We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page, and your continued use after such posting constitutes acceptance of the revised Terms.

Eligibility and Membership

To become a member of Hungardia, you must be at least 16 years of age. Members aged 16 or 17 require written parental or guardian consent. When registering, you agree to provide accurate, current, and complete information and to update it as necessary.

Membership plans, pricing, and inclusions are detailed on our website and at our facilities. All fees are quoted in Australian dollars unless otherwise stated. By selecting a membership plan, you authorise us to charge the applicable fees to your nominated payment method on a recurring basis according to the billing cycle of your chosen plan.

We reserve the right to adjust membership fees with at least 30 days written notice. If you do not accept a fee change, you may cancel your membership before the new rate takes effect.

Facility Access and Usage

Members are granted access to our fitness facilities during the hours and under the conditions specified by their membership tier. Access may be via key card, PIN code, or another method we designate. You must not share your access credentials with anyone else. Lost or stolen access devices must be reported immediately, and a replacement fee may apply.

Member Conduct

When using our facilities, website, or interacting with staff and other members, you agree to:

  1. Treat all staff, trainers, and fellow members with respect and courtesy.
  2. Use equipment safely and in accordance with posted instructions. Return equipment to its designated area after use.
  3. Wear appropriate athletic attire and closed-toe footwear at all times while exercising.
  4. Wipe down equipment after each use with the cleaning supplies provided.
  5. Refrain from any behaviour that is threatening, abusive, discriminatory, or disruptive.
  6. Not bring prohibited items into the facility, including alcohol, illegal substances, glass containers, or weapons.
  7. Comply with all posted rules, signage, and reasonable directions from staff.

Failure to adhere to these conduct standards may result in a warning, temporary suspension, or permanent termination of your membership at our sole discretion, without refund.

Health and Safety Disclaimer

Physical exercise carries inherent risks. Before commencing any fitness program, we strongly recommend consulting a qualified medical professional, particularly if you have pre-existing health conditions, injuries, or concerns. By using our facilities and services, you acknowledge that you participate at your own risk and accept full responsibility for any injury, illness, or loss that may occur during or as a result of your use of our services, except to the extent caused by our negligence.

Intellectual Property

All content on this website — including text, graphics, logos, images, videos, and software — is the property of Jetts Fitness Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

Limitation of Liability

To the maximum extent permitted by law, Hungardia, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, facilities, or services. Our total liability for any claim related to our services is limited to the amount of fees you have paid to us in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.

Suspension and Membership Freezes

You may request a temporary freeze on your membership for medical reasons or extended travel. Freeze requests must be submitted in writing at least seven days in advance. Freezes are available for a minimum of two weeks and a maximum of twelve weeks per calendar year. A nominal administration fee may apply during the freeze period.

Termination and Cancellation

You may cancel your membership at any time by providing 30 days written notice via email or through our website. Cancellations take effect at the end of the current billing period following the notice period. We may terminate your membership immediately and without refund if you materially breach these Terms, engage in misconduct, or fail to pay fees after reasonable attempts to collect.

Our website may contain links to external websites or services that are not operated by us. We are not responsible for the content, privacy practices, or availability of any third-party sites. Accessing external links is at your own risk.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any dispute arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales. Before commencing legal proceedings, both parties agree to attempt resolution through good-faith negotiation and, if necessary, mediation administered by the Australian Disputes Centre.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
